Just had an auto accident and don't know what to do? Continue reading to find out what steps you need to take after an auto accident to better set you up for a personal injury claim or case. 


  1. First thing you need to do is make sure you are out of harm's way. If you are able to safely get out of your vehicle without the assistance of emergency responders and get to the side of the road or median, please do so. Additionally, if you are able to move your vehicle to the side of the road or to a median, please do so. But before you move either yourself or the vehicle, document by way of photos or videos the position of the vehicles at the point of collision. However, if you require assistance to get out of your vehicle and or you cannot move your vehicle to the side or median, do NOT attempt to do so. Instead, remain in your vehicle until police or emergency responders arrive.

  2. Do not admit fault or speak to any other drivers. Refrain from using phrases like, "I did not see you." or "I am sorry." These types of phrases can damage your future personal injury claim or case and tend to place some sort of fault or liability on your part. Instead, ask if everyone is OK without admitting who was at fault or who is to blame.

  3. Call 911. It is always best to call 911 and let the police arrive to make a report of the accident and drivers/passengers/witnesses. Although a police report is not admissible in trial, it does help your case. Provide the police with an accurate statement of how the accident happened and show photos or videos if you have moved the vehicle to a safer area or position.

  4. Document the scene. Be sure to take photos and videos of the vehicles while they're in their final resting position, the damage to your vehicle and any other vehicles involved, and any visible injuries to your body such as cuts, scrapes, or bruising.

  5. Gather witness information, if applicable. If you have a witness present and he or she saw the accident happen and can help in establishing fault, make sure to gather that witness's name, number and email, if possible. Witnesses are not needed but will tremendously help your case if they can confirm that you were not the at-fault driver and can paint a better picture of how the accident occurred.

  6. Seek medical attention. Under the state of Florida, you only have a limited number of days to seek medical attention after an auto accident for benefits. If you experienced a rapid, back-and-forth movement in your neck or body, you may have underlying injuries that need medical attention and treatment. Headaches are also a sign that there may be issues in your body like a pinched nerve or herniated disc that may require medical attention. Do not hesitate and seek medical attention at an urgent care, chiropractor or your primary care physician.
